We strive to maintain 99.9% uptime for our core Services, excluding scheduled maintenance and circumstances beyond our control.

Support levels vary by subscription plan:

  • Starter Plan: Email support with 48-hour response time
  • Business Plan: Priority support with 24-hour response time
  • Enterprise Plan: Dedicated account manager and priority support

8.3 Maintenance

We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without prior notice when necessary to maintain service integrity.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 AI and Automation Disclaimer

While our AI systems are designed to be highly accurate and reliable, we do not guarantee the accuracy, completeness, or performance of any automated processes or AI-generated content. You are responsible for reviewing and verifying all automated actions and generated content.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BMB NEXUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICES.

9.4 Maximum Liability

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BMB Nexus, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorney fees) arising from:

11. Termination

We may suspend or terminate your account immediately if you:
